Elekta receives notification that the U.S. Supreme Court denies opponent´s petition in patent dispute
ELEKTA RECEIVES NOTIFICATION THAT THE U.S. SUPREME COURT DENIESOPPONENT'S PETITION IN PATENT DISPUTEAs previously announced, Medical Instrumentation and DiagnosticsCorporation (Midco), Elekta's opponent in the U.S. patent dispute, inJanuary filed a petition for a writ of certiorari with the United StatesSupreme Court. The petition requested the Supreme Court to review of theFederal Circuit's judgment vacating the prior judgment of the DistrictCourt in this case and absolving Elekta of all liability.On March 29, the United States Supreme Court issued its decision denyingMIDCO's petition for a writ of certiorari.Following the Federal Circuit's judgment in favor of Elekta, MIDCO hasrecently also filed a motion to amend its complaint in the DistrictCourt and requested that it be allowed to amend its case to be based ondifferent claims of the patents in question. Elekta has opposed MIDCO'smotion. Elekta believes that it is unlikely that MIDCO could prevailunder any of the claims of the patents.
